Public Hearing called to order at 7:44 PM.
~~PUBLIC HEARING:
1. ZBA2016-10 Application for Special Exception to open an Antique/Flea market Mall selling household items, furniture, clothing and collectibles at 165 River Road Representative for Owner: Ruiling Wei Applicant: Ruiling Wei (Received and Public Hearing October 13, 2016 Decision within 65 days after close of P. H.)
Mark Masinda asked about the new document that she had submitted. She said that people she talked to did not want to use the rooms in the buildings they preferred to use the open area in the barn.
Ruiling Wei said that she wanted to change the hours the Antique Mall would be open and add the barn area to the floor plan.
M. Masinda explained to her that the public hearing had been open and in the original application the barn was to be used for storage. If she wants to make changes she would have to submit a new application.
R. Wei said that she would stay with the original application.
R. Maloney said that the documents that the Board Members requested, the hours of operation, lighting plan, parking plan, and picture showing the buffer zone has been submitted the application has the approval from EHHD. He said that approvals would be needed from zoning department, building department and fire marshal before the building can be occupied.
M. Masinda asked if anyone wanted to speak either for or against the application.
Dennis Zelinsal was present to speak in favor of the application. He asked to have it approved as fast as possible. He said that people are calling wanting to know when it will open.
Jack Rup wanted to have some clarification as to which buildings were going to be used and the location of the buildings. R. Wei look at the material submitted and showed the Members the two building in the front that would be used. R. Wei crossed out the ones that would not be used, signed and dated the material in the application. The parking plan shows 40 parking places including 2 spaces for handicap parking. At this time the paved area will be used for parking. The over flow parking in the rear of the building has been crossed off.
M. Masinda said the barn is not in consideration at this time. It may be used for storage as stated in original application.
M. Masinda closed the Public Hearing.
2. ZBA2016-8 Application for variance from section 4.04 Buildable Area at 61 Turnpike Road (Map 45 Lot 06 Zone DI) Owner/Applicant: Kurt Lessenger (Received September 8, 2016 Public Hearing September 8, 2016 extension requested by the applicant decision within 65 days after close of P. H.)
M. Masinda said that he was not at the first P.H. but had listened to the tape.
J. Rup, .R. Maloney and A. Poole were at the site walk.
Kurt Lessenger was present to speak about the application. He said that the Board Members had requested additional information about the buildable area. He said the map has been redrawn to show the 40 thousand sq. ft. of near rectangular area that is free of wetlands.
K. Lessenger showed the line in the east side of the lot that did not meet the regulations that states no sides less than 150’.
R. Maloney asked if anyone wanted to speak either for or against the application. No one spoke.
K. Lesserger submitted the new plan to be added to the application.
M. Masinda closed the Public Hearing.
3. ZBA2016-13 Application for variance from section 8 and 4.05 19’ side yard and front yard for garage at 45 Cowles Road (Map 16 Lot 24 Zone R80) Owner/Applicant: Tracy Fish (Received and Public Hearing December 8, 2016 Decision within 65 days after close of P.H.)
Tracy Fish was present to speak about his application. He said he would like to put in a two car modular garage that would seat on top of the ground. He said that the company had sent out a site prep representative to do an inspection of the property for a location for the garage. He chose a place that would be a good location without add any major expenses and extra work. The hardship is that there is no flat area in the yard.
Site walk done on December 3, 2016.
The applicant submitted picture showing the location the proposed garage. The applicant said the yard has many different levels and slope.
J. Rup asked if the applicant had any records from the site prep representative that had used a laser to check the level of the land. If it was be put in a different location it would need to level. The representative said the area marked off would be the optimum location.
R. Maloney asked if anyone wanted to speak either for or against the application.
Doreen Fish spoke in favor.
Mike Staczek spoke in favor of the application.

1. R. Maloney motion to approve the two front building to be used as an Antique Mall (excluding the barn for retail space it may be used for storage and excluding over flow parking) with the condition that all lighting must meet zoning regulation and prior to use and occupancy approvals from zoning department, building department and fire marshal.
The Board Members discussed the application there will be 40 parking places in the front of the building including 2 spaces for handicap parking. Four employees, the hours of operation will be 10-6 during daylight saving time and 10 – 8 Thursday Friday and Saturday.
W. Bland seconded the motion. All voted in favor
2. ZBA2016-8 Application for variance from section 4.04 Buildable Area at 61 Turnpike Road (Map 45 Lot 06 Zone DI) Owner/Applicant: Kurt Lessenger (Received September 8, 2016 Public Hearing September 8, 2016 extension requested by the applicant decision within 65 days after close of P. H.)
J. Rup motion to approve a variance to regulation 4.04 buildable area the applicant meets the 40 thousand square feet nearly rectangle as possible but not the side line requirements of a minimum of 150’ on the eastern side of the lot. A 90’ variance is needed to meet the minimum side line requirements. Map submitted titled Improvement Location Survey prepared for Kurt Lessenger Proposed Building Addition 61 Turnpike Road Willington Connecticut Sheet NO.: 1 of 1 Scale 1’= 50’
The Board Members discussed the industrial zone and the need for more businesses in the area.
J. Prusak seconded the motion. All voted in favor.
3. ZBA2016-13 Application for variance from section 8 and 4.05 19’ side yard and front yard for garage at 45 Cowles Road (Map 16 Lot 24 Zone R80) Owner/Applicant: Tracy Fish (Received and Public Hearing December 8, 2016 Decision within 65 days after close of P.H.)
R. Maloney motion to approve a 19’ side yard variance and a front yard variance. J. Prusak seconded the motion. Motion to approve J. Prusak voted in favor. Opposed M. Masinda, J. Rup, R. Maloney and B. Bland. Variance has been denied.
